Be sure on this – the Digital Economy Act is an abysmally poor piece of legislation and always has been. From conception through to implementation, those involved should be held to account for very bad law. The judicial review is a right and proper thing. Which cannot be said of the activities of BT, TalkTalk, the previous “government” and rights holders (and their lawyers) who pursue individuals based on unverified methodology and threatening behaviour.
Natural justice involves Mr Livingston and the other BT & Phorm excutives involved in this case facing charges in a Court of Law over their involvement with the illegal interception of thousands of peoples’s internet traffic.
This is good news and something I have been saying for a long time now:there needs to be a full legal reckoning with the BT and Phorm executives responsible for these breaches of the law held to account. In court.
Is this the start of a major change in the way organisations engage with their customers? I hope so. Customer service and ethics need to be truly at the heart of organisations’ cultures. I don’t mean overdosing on those supposedly “motivational” posters. I mean by ensuring every staff member works to an accountable code of conduct and standard. I mean by ensuring that every customer’s communication is welcomed rather than just “processed in line with procedures”. I mean by organisations employing people who truly believe in doing the right thing rather than programmable drones. I mean by organisations being open and honest with customers, not hiding behind misleading spin and mendacity.
2009 will be a year I remember as a year in which far too many people lacked Clue, balls and ethics.
I challenge Neil Berkett (Virgin Media CEO) in the same way I have Kent Ertugrul: publish a qualified verifiable legal opinion confirming that the CView system Virgin Media want to use does not breach UK and EU law.
